HvJ zaak C-108/09 Ker-Optika Jur. 2010, p. I-12213 - Arrest

Onderwerpen: Vrij verkeer van goederen – Volksgezondheid – Verkoop van contactlenzen via internet – Nationale regeling volgens welke contactlenzen uitsluitend in speciaalzaken voor medische hulpmiddelen mogen worden verkocht – Richtlijn 2000/31/EG – Informatiemaatschappij – Elektronische handel.

Casus:
In dit arrest ging het om een verzoek om een prejudiciële beslissing betreft de uitlegging van richtlijn 2000/31/EG van het Europese Parlement en de Raad betreffende juridische aspecten van de diensten van de informatiemaatschappij (vooral elektronische handel in de interne markt en van de artikelen 34,36 VVWEU). Dit verzoek is ingediend in het kader van een geding over een administratieve beslissing krachtens welke de overheidsinstantie Ker-Optika heeft verboden om contactlenzen via internet te verkopen.

Hof:
Het Hof verklaart dat nationale regels inzake de verkoop van contactlenzen binnen de werkingssfeer van de richtlijn van het Europees Parlement en de Raad vallen (betreffende juridische aspecten van de diensten van de informatiemaatschappij), met name de elektronische handel in de interne markt. Dit voor zover zij de overeenkomst voor de verkoop van deze lenzen via internet betreffen.

Nationale voorschriften betreffende de levering van deze lenzen vallen daarentegen buiten de werkingssfeer van deze richtlijn. De artikelen 34 en 36 VWEU en de richtlijn 2000/31 moeten zo worden uitgelegd dat zij zich verzetten tegen een nationale regeling volgens welke contactlenzen uitsluitend en alleen in speciaalzaken voor medische hulpmiddelen mogen worden verkocht.
