Casus
De belangen van de huurders van de woningen in het Nellestein-complex in Amsterdam Zuidoost worden door de Bewonersvereniging Nellestein behartigd. Deze woningen worden verhuurd door Ymere. Ymere vraagt bij het sluiten van de huurovereenkomsten voor de woningen een vergoeding van de huurders voor de verhuurkosten van € 125. De Bewonersvereniging is van mening dat Ymere alleen het bedrag van € 26,50 mag vragen, en dit bedrag is de vergoeding voor een naamplaatjeen het aanvragen van de huisvestingsvergunning. Daarbij valt het restbedrag, van ongeveer € 100, volgens de bewoners onder ‘niet redelijk voordeel’. Hierdoor verzoeken de huurders de kantonrechter om zijn oordeel over deze kwestie te geven en Ymere te verbieden aan nieuwe huurders meer dan € 26,50 in rekening te brengen.
Hoge Raad
De kantonrechter wijst de eis toe. Volgens de Hoge Raad gaat het vooral om de situatie waarin bij het aangaan van de huurovereenkomst de huurder ten opzichte van de verhuurder niet in een gelijkwaardige positie verkeert. Daarom moet als uitgangspunt volgens de Hoge Raad worden genomen dat van een ‘niet redelijk voordeel’ sprake is indien tegenover het bedongen voordeel geen of een verwaarloosbare tegenprestatie staat. Dus een verhuurder mag alleen verhuurkosten vragen als deze nieuwe huurder voor die kosten iets concreets terugkrijgt.
