Rechtsregel:

Oplegging van een disciplinaire straf van intrekking van het eerstvolgende weekendverlof is in strijd met de wet, als op geen enkele wijze aannemelijk wordt dat huisregels overtreden zijn.

 

Casus:

De klager heeft een disciplinaire straf van intrekking van het eerstvolgende weekendverlof gekregen, omdat er een mobiele telefoon is gevonden in de gezamenlijke ruimte van het appartement. De beoordelingscommissie moet beslissen of deze beslissing rechtens juist is geweest.

Klager geeft aan dat de directeur afgegaan is op het opgemaakte rapport. Bij het opmaken van het rapport is niet aan klager gevraagd of de gevonden mobiele telefoon van hem was. Volgens de raadsman van klager is de disciplinaire straf in strijd met de wet, nu zijn schuld aan het overtreden van de huisregels niet is komen vast te staan. Het opleggen van eenzelfde straf aan alle vier bewoners van het appartement terwijl maar één de schuldige geweest kan zijn, is in strijd met het beginsel ‘geen straf zonder schuld’.

 

Beoordeling BC:

De BC is van mening dat de beklagcommissie ten onrechte is uitgegaan van het standpunt van de directeur, zonder de argumenten van klager mee te wegen.

Een ordemaatregel mag altijd opgelegd worden. Een disciplinaire straf zoals in casu kan alleen opgelegd worden wegens het begaan van feiten die onverenigbaar zijn met de orde of de veiligheid van de inrichting dan wel met de ongestoorde tenuitvoerlegging van de vrijheidsbeneming. Nu niet duidelijk geworden is dat klager zich hieraan schuldig heeft gemaakt is de oplegging van de disciplinaire straf in strijd met de wet.

 

Oordeel BC:

Het beroep wordt gegrond verklaard en de beslissing van de directeur wordt vernietigd. De directeur wordt opgedragen een nieuwe beslissing te nemen met inachtneming van de uitspraak van de BC.

    • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
