Artikel 4 (4), laatste volzin EVO moet zo worden uitgelegd dat het aanknopingscriterium van dit artikel 4 (4) 2e volzin, slechts van toepassing is op een bevrachtingsovereenkomst niet zijnde een overeenkomst tot bevrachting voor een enkele reis, wanneer de overeenkomst hoofdzakelijk niet de enkele terbeschikkingstelling van een vervoermiddel, maar het eigenlijke vervoer van de goederen betreft.
Artikel 4 (1), 2e volzin EVO moet zo worden uitgelegd, dat een deel van de overeenkomst alleen door een ander recht kan worden beheerst dan het recht dat wordt toegepast op de rest van de overeenkomst, indien het voorwerp ervan autonoom is.
Wanneer het aanknopingscriterium dat op een bevrachtingsovereenkomst wordt toegepast, het criterium van artikel 4 (4) EVO is, moet dit criterium op de gehele overeenkomst worden toegepast, tenzij het deel van de overeenkomst betreffende het vervoer autonoom is ten opzichte van de rest van de overeenkomst.
Artikel 4 (5) EVO moet zo worden uitgelegd dat wanneer uit het geheel der omstandigheden duidelijk blijkt dat de overeenkomst nauwer is verbonden met een ander land dan het land dat wordt bepaald op basis van een van de criteria van artikel 4 (2), (3) en (4) EVO, de rechter die criteria buiten toepassing dient te laten en het recht dient toe te passen van het land waarmee die overeenkomst het nauwst is verbonden.
