Onderlinge weigering van toegang   

In artikel 13 lid 2 van de Schengengrenscode (Verordening (EG) 562/2006) is bepaald dat de toegang alleen kan worden geweigerd in een met redenen omklede beslissing waarin precieze weigeringsgronden worden genoemd. Deze beslissing wordt genomen door een naar nationaal recht bevoegde instantie. Zij is onmiddellijk van toepassing.           

De eis van schriftelijkheid is een vormvoorschrift over de wijze waarop de toegang moet worden geweigerd. Er is geen grond om de schending van dit vormvoorschrift met toepassing van artikel 6:22 Awb te passeren, aangezien in het bepaalde van deze verordening een essentiële rechtswaarborg ligt besloten waardoor voor de vraag of verzoeker door schending van het vormvoorschrift is benadeeld geen plaats is. 

De voorziening die wordt getroffen is dat verzoeker door de staatssecretaris dient te worden behandeld als ware hem de toeging niet geweigerd.       

Nu er naar het oordeel van de voorzieningenrechter voor het in stand laten van het besluit tot toegangsweigering en een beoordeling van de vraag of eiser door de schending van het vormvoorschrift ten aanzien van deze toegangsweigering is benadeeld, geen plaats is, en de voorzieningenrechter in verband hiermee de voorziening heeft getroffen dat eiser hangende het administratief beroep behandeld dient te worden als ware hem de toegang nog niet geweigerd, is bij het opleggen van de maatregel ex artikel 6 lid 1 en 2 Vw geen sprake geweest van een vreemdeling aan wie de toegang tot Nederland is geweigerd. Derhalve is de ambtenaar belast met grensbewaking niet bevoegd geweest eiser voormelde vrijheidsontnemende maatregel op te leggen. De oplegging en voortduring van de aan eiser opgelegde maatregel is derhalve onrechtmatig te achten. Opheffing van de maatregel wordt bevolen.

    • The topics and taxonomy of the study and working fields gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution. Note: not all content is tagged thoroughly, so when this approach doesn't give the results you were looking for, please check the search tool as back up
  3. Check or follow your (study) organizations:
    • by checking or using your study organizations you are likely to discover all relevant study materials.
    • this option is only available trough partner organizations
  4. Check or follow authors or other WorldSupporters
    • by following individual users, authors  you are likely to discover more relevant study materials.
  5. Use the Search tools
    • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
