De Internationale Kamer van Koophandel (hierna: IKVK) heeft regels vastgesteld ter zake van de documentaire accreditiefstelling. Dit heeft de IKVK gedaan door middel van de Uniform Customs and Practice for Documentary Credits (hierna: UCP). Regels dienen expliciet naar deze regeling te verwijzen, aangezien de UCP niet in ieder land gewoonlijk wordt toegepast. Vaak wordt het dan ook als voorwaarde voor het sluiten van een overeenkomst genoemd. Een documentair accreditief is volgens art. 3 UCP onherroepelijk.
De IKVK heeft een formulier ontworpen dat ingevuld moet worden bij de aanvraag van een documentair accreditief. Op dit formulier worden de instructies vermeld, bv. hoe de betaling geschiedt. Hierbij is art. 4 sub b UCP belangrijk.
Indien de persoon die een accreditief wil aanvragen niet aan de vereisten voldoet, mag de bank hem dit document weigeren. De documenten moeten namelijk kloppen. De bank hoeft niet te controleren of de afspraken tussen de begunstigde en zijn wederpartij zijn nageleefd. Wel heeft de bank ingevolgde art. 14 UCP de verplichting de documenten te controleren op overeenstemming met de voorwaarden van het documentair accreditief. Geweigerd wordt als zich strijd voordoet tussen de documenten. De bank is echter niet verplicht de documenten te controleren op werkelijkheid.
Documentaire accreditieven zijn allereerst te onderscheiden in herroepelijke dan wel onherroepelijke accreditieven. De UCP gaat uit van de onherroepelijke. Daarnaast bestaat de mogelijkheid tot overdraagbaarheid. Dit kan niet door de begunstigde, maar het kan wel worden ter beschikking gesteld aan een tweede begunstigde. De openende bank kan het recht overdragen op verzoek van de begunstigde (art. 38 UCP). Zodra de bank het accreditief als overdraagbaar heeft aangemerkt, is dit mogelijk en zal dit worden geaccepteerd. Indien het verzoek bij een andere bank is ingesteld dan de openende bank, is uitdrukkelijke toestemming voldoende.
De bank verplicht zich tegenover de begunstigde tot het betalen van een geldsom bij het uitbetalingsaccreditief. Als er voldoende middelen ter beschikking zijn gesteld, kan de bank meewerken (art. 127a K). Uitbetaling kan ook door middel van het acceptatieaccreditief. De bank verplicht zich dan een wissel van de begunstigde te accepteren.
De begunstigde kan ook een wissel trekken en deze vervolgens verkopen aan de bank, dit heet het negotiatieaccreditief. De bank kan zich met die wissel verhalen op de opdrachtgever.
Dit wordt gebruikt bij doorverkoop, om zekerheid te stellen ten gunste van de leverancier. De accreditieven worden dan onder dezelfde voorwaarden te stellen, zodat de bank beschikking krijgt over de documenten. De bank kan dan zonder tussenkomst van de handelaar de zaak afwikkelen.
Het anticipatory of advanced payment credit is een accreditief waarbij de begunstigde voordat hij de documenten aanbiedt, een voorschot krijgt. Dit krijgt hij omdat hij bv. kosten moet maken voor het leveren van de zaken.
Een opdrachtgever kan voor deze soort credit kiezen als hij veel transacties verricht die zien op een bepaalde periode. Hij moet dan bij de bank zorgen dat hij een langere periode hetzelfde bedrag uit heeft staan, ten hoogte van de verschuldigde transactie. Dit blijft zo totdat de accreditief is betaald.
