Lisanne is 20 jaar werkt als bollenpeller voor Boerenbedrijf ‘De bollenstreek’. Zij heeft doet dit vanaf 1 januari 2015 en zal nog tot 1 juli 2016 deze functie uitoefenen. Lisanne en de eigenaar van het bedrijf (Boer Guus) hebben daartoe een overeenkomst, genaamd ‘Overeenkomst tot het verrichten van ondersteunende landbouwwerkzaamheden (hulpkrachtovereenkomst)’ ondertekend. In deze overeenkomst is één maand proeftijd opgenomen.Lisanne werkt 20 uur per week en werkt elke dag van 07:00 uur tot 11:00 uur en doet dit aan de bollenpelband van het bedrijf, waar zij aan het einde van haar werktijd minstens 5000 bollen moet hebben gepeld. Voor haar werkzaamheden verdient Lisanne 1,30 euro per uur.Charlotte werkt ook op het boerenbedrijf van Guus, maar werkt slechts als oproepkracht in het hoogseizoen. Zij heeft met boer Guus een arbeidsovereenkomst gesloten voor de maanden juli, augustus, september en oktober 2015. In de arbeidsovereenkomst met boer Guus is een proeftijd van één maand afgesproken.In de eerste maand al komt boer Guus erachter dat Charlotte wel wat langzaam is bij het pellen van bollen en de andere werkzaamheden. Hij ontslaat haar om die reden per direct op 16 juli 2015, nu boer Guus vindt dat zij niet optimaal functioneert. Zij kost hem eigenlijk alleen maar geld.Zowel bij Lisanne als Charlotte is een concurrentiebeding in de schriftelijke arbeidsovereenkomst opgenomen. Het concurrentiebeding luidt als volgt:“Het is de werknemer verboden om binnen een tijdvak van twaalf maanden na het einde van de arbeidsovereenkomst:op basis van een arbeidsovereenkomst - direct of indirect (zoals via een uitzendbureau) - arbeid voor een Concurrent te verrichten, ofals zelfstandig ondernemer - direct of indirect (zoals via een vennootschap) - arbeid te verrichten.Dit concurrentiebeding heeft betrekking op een geografisch gebied dat gelegen is...
