Reesink/Gemeente Apeldoorn

Casus

Reesink heeft van de Gemeente Apeldoorn een bedrijfsterrein gekocht. Bij vonnis van 18 januari 2001 is de Gemeente veroordeeld om Reesink toegang tot het terrein te verschaffen, bij gebreke waarvan de Gemeente een dwangsom verbeurt.

Reesink vordert in onderhavig geding betaling van verbeurde dwangsommen op de grond dat zij gedurende een periode van tien dagen geen toegang tot het terrein had.

Rechtbank en hof hebben de vordering afgewezen. Het hof oordeelde de dwangsommen verjaard en verwierp in dat verband zowel het beroep van Reesink op stuiting door onderhandelingen als haar beroep op artikel 6:2 lid 2 BW. Hiertegen keert zich het middel.
 

Hoge Raad

(Ook) in het geval partijen in onderhandeling zijn, is voor stuiting van de verjaring een schriftelijke aanmaning of een schriftelijke mededeling als bedoeld in artikel 3:317 BW vereist.

Stemt een schuldenaar toe in onderhandelingen, dan is denkbaar dat hij zich naar maatstaven van redelijkheid en billijkheid over die periode niet op verjaring kan beroepen. Een beroep op artikel 6:2 lid 2 BW kan evenwel slechts in uitzonderlijke omstandigheden gegrond worden geacht en genoegzame concrete feiten moeten zijn aangevoerd waarop dit beroep kan worden gegrond. De enkele stelling dat de schuldenaar, gelet op de onderhandelingen, moet hebben begrepen dat de schuldeiser zijn aanspraak wenste te handhaven is daarvoor onvoldoende.
