Een ‘comfort letter’ is een administratief schrijven, waarbij de betrokken onderneming in kennis wordt gesteld van de opvatting van de Commissie dat er voor haar geen aanleiding bestaat om krachtens artikel 101 VWEU tegen de overeenkomst op te treden en dat de zaak dus kan worden afgesloten.
Een dergelijke brief staat er niet aan in de weg dat de nationale rechterlijke instanties voor wie een beroep op de onverenigbaarheid van de betrokken overeenkomst met artikel 101 VWEU wordt gedaan, op grond van de gegevens waarover zij beschikken, tot een afwijkend oordeel over die overeenkomsten komen. Het in dergelijke brieven meegedeelde standpunt bindt de nationale rechterlijke instanties niet, maar het vormt toch een feitelijk gegeven waarmee zij rekening kunnen houden bij hun onderzoek van de vraag of de overeenkomsten of gedragingen in overeenstemming zijn met artikel 101 VWEU.
