Casus
De Staat heeft vergoeding van een aantal blikschade gevallen aan verzekeraar Amev gevraagd. Deze heeft zonder debat prompt betaald inclusief de gemaakte expertise kosten. Amev weigert de door de Staat gemaakte administratiekosten, door de Staat intern gemaakt, voor verkrijging van voldoening buiten rechte te betalen.

Rechtsregel
Het tweede lid van art. 6:96 noemt de kosten die in aanmerking komen voor vergoeding. Tot deze kosten behoren ook de administratiekosten voor zover zij redelijk zijn. Ze moeten binnen een redelijke omvang blijven en het moet in de gegeven omstandigheden redelijk zijn om ze te maken. De schade dient te worden begroot op de wijze die meest met de aard ervan in overeenstemming is. De begroting van de rechter is niet gebonden aan de normale regels van stelplicht en bewijslast, hij mag de omvang schatten.
