Casus:

De erven Smit hebben een vordering ingesteld tegen Bruinsma. Zij heeft gedurende enige tijd tot aan zijn overlijden met Smit heeft samengewoond. De vordering strekt tot afgifte van het bedrag dat Bruinsma als gemachtigde van Smit, zij het na zijn overlijden, van zijn girorekening had opgenomen. Dit bedrag zou volgens de erven tot de nalatenschap behoren. Bruinsma verweert tegen deze vordering tot afgifte, stellende dat het saldo op de rekening mede aan haar toekomt, nu zij met Smit had afgesproken dat zij bepaalde huishoudelijke kosten zou betalen waar tegenover Smit dan voor hen beiden op zijn rekening zou sparen. De rechtbank heeft de vordering afgewezen, het hof Bruinsma veroordeeld tot betaling van het bedrag aan de erven.

 

Hoge Raad:

De samenleving als zodanig tezamen met het gezamenlijk dragen van de kosten van die samenleving leidt niet tot een vermoeden van gemeenschap tussen de samenlevende partners.

 

Voor het antwoord op de vraag of tussen samenlevende partners enige gemeenschap van goederen bestaat, is beslissend wat zij dienaangaande uitdrukkelijk of stilzwijgend zijn overeengekomen.

 

De enkele omstandigheid dat Bruinsma en Smit aparte rekeningen hadden en ieder van hun gezamenlijke kosten bepaalde uitgaven voor hun rekening namen, staat er niet aan in de weg dat krachtens een overeenkomst als hiervoor bedoeld tussen hen gemeenschap van een of meer vermogensbestanddelen kan hebben bestaan en sluit niet uit dat zij als deelgenoten tezamen gerechtigd kunnen zijn geweest tot het tegoed op de rekening ten name van een van beiden, in dit geval Smit.

    • by checking or using your study organizations you are likely to discover all relevant study materials.
    • this option is only available trough partner organizations
  4. Check or follow authors or other WorldSupporters
    • by following individual users, authors  you are likely to discover more relevant study materials.
  5. Use the Search tools
    • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
