Casus
Abbo c.s. heeft van de Stichting woningen gehuurd die zijn gelegen in Renesse. Deze woningen mochten niet permanent bewoond worden en de huurders stonden elders ingeschreven in de gemeentelijke basisadministratie. In deze zaak ging het om de vraag of de huur van de zomerwoningen onder de ‘korte duur- uitzondering’ viel en niet om de daaraan voorafgaande vraag of de zomerwoningen waren verhuurd als woning.
Hoge Raad
Het gaat om de vraag of de woonruimtebepalingen van toepassing waren op de huur en verhuur van bepaalde zomerwoningen in Renesse. De Hoge Raad overwoog of de omstandigheid dat de huurders (ook) elders onderdak hadden, niet tot gevolg hoefde te hebben dat hun bescherming die de woonruimtebepalingen aan huurders van woonruimte bieden, moest worden onthouden. De woonruimtebepalingen kunnen dus ook van toepassing zijn op de huur en verhuur van een tweede woning die niet permanent mag worden bewoond en waarbij de huurder van die woning elders zijn woonplaats heeft.
De Hoge Raad neemt als uitgangspunt dat een huurovereenkomst niet snel onder de korte-duur uitzondering valt.
