De mogelijke uitkomst van een exequaturprocedure regardeert de toelaatbaarheid van de uitlevering niet.
De opvatting dat de exequaturrechter – na overdracht van de gevonniste persoon aan Nederland – het in artikel 3 lid 1, onder c, WOTS vervatte vereiste van strafbaarheid van de feiten naar Nederlands recht dient te beoordelen naar het moment waarop die feiten zijn gepleegd, is onjuist.
De strekking van dat vereiste is immers te voorkomen dat Nederland medewerking zou moeten verlenen aan het handhaven van normen die met de eigen rechtsopvattingen in strijd zijn, of waarbij althans een strafsanctie misplaatst wordt geacht.
Voor de beantwoording van de vraag of aan genoemd vereiste is voldaan is daarom beslissend of die feiten naar Nederlands recht strafbaar zijn ten tijde van de beslissing van de daartoe ingevolge de WOTS aangewezen rechter op de vordering tot tenuitvoerlegging.
Het verlenen door die rechter van een verlof tot tenuitvoerlegging kan niet worden aangemerkt als ‘berechting en bestraffing’ van die feiten, zodat ingeval van een dergelijk verlof ten aanzien van feiten die op het tijdstip waarop zij zijn gepleegd naar Nederlands recht nog niet strafbaar waren gesteld, van schending van het legaliteitsbeginsel geen sprake kan zijn.
