Duijf/Bolt (HR 10-10-2008, LJN BD7601; NJ 2009/1)
Casus
De grootouders van Bolt waren eigenaar van een boerderij met erf op Terschelling. De ouders van Duijf hebben in 1942 met toestemming van de eigenaren op een gedeelte van dat erf een recreatiewoning geplaatst. In de onderhavige procedure heeft Duijf zich op het standpunt gesteld primair dat zij – de rechtsopvolgster van haar ouders – door verjaring op de voet van artikel 3:105 lid 1 BW de eigendom heeft verkregen van de grond waarop de recreatiewoning is geplaatst en subsidiair dat zij door zodanige verjaring een recht van opstal met betrekking tot de recreatiewoning heeft verkregen, aangezien zij (evenals haar ouders voorheen) bezitter is van de grond dan wel van het recht van opstal en de rechtsvordering van Bolt tot beëindiging van het bezit ingevolge artikel 3:306 BW is verjaard. In hoger beroep was, en in cassatie is, uitsluitend nog dit subsidiaire standpunt in geschil. Het hof oordeelde dat geen sprake kon zijn van bezit van het gepretendeerde recht van opstal nu Duijf zich in de procedure tevens erop had beroepen bezitter van de grond te zijn, omdat het als bezitter houden van een goed voor zichzelf uitsluit dat die bezitter tevens bezitter is van een beperkt zakelijk recht met betrekking tot dat goed.
Hoge Raad
Volgens de Hoge Raad geeft het oordeel van het hof dat de door Duijf aangevoerde feiten en omstandigheden, die door haar in eerste aanleg mede als grondslag waren aangevoerd voor haar door de rechtbank verworpen standpunt dat haar ouders of zij door verjaring de eigendom hebben verkregen van het perceel met de daarop gebouwde recreatiewoning, evenmin kunnen meebrengen dat haar ouders of zij door verjaring een recht van opstal hebben verkregen, reeds omdat die gestelde feiten en omstandigheden niet wijzen op het, voor zodanige verjaring vereiste, ondubbelzinnige bezit van het recht van opstal, niet blijk van een onjuiste rechtsopvatting en is het in het licht van de gedingstukken alleszins begrijpelijk.
