Casus
Het gaat in deze zaak om de vereisten, strekking, en ratio van de bewijsrechtelijke omkeringsregel.
Hoge Raad
De omkeringsregel strekt ertoe dat in bepaalde gevallen een uitzondering wordt gemaakt op de hoofdregel van artikel 150 Rv, en wel zo dat het bestaan van causaal verband (in de zin van conditio sine qua non-verband) tussen een onrechtmatige daad of tekortkoming en het ontstaan van de schade wordt aangenomen, tenzij degene die wordt aangesproken bewijst – waarvoor in het kader van het hier te leveren tegenbewijs voldoende is: aannemelijk maakt – dat de bedoelde schade ook zonder die gedraging of tekortkoming zou zijn ontstaan.
Voor toepassing van deze regel is vereist dat sprake is geweest van een gedraging in strijd met een norm die strekt tot het voorkomen van een specifiek gevaar ter zake van het ontstaan van schade, en dat degene die zich op schending van deze norm beroept, ook bij betwisting aannemelijk heeft gemaakt dat in het concrete geval het (specifieke) gevaar waartegen de norm bescherming beoogt te bieden, zich heeft verwezenlijkt. De voorwaarde dat het specifieke gevaar ‘aanmerkelijk moet zijn vergroot’ is geen geldend recht.
Is aan de vereisten voor toepassing van de omkeringsregel voldaan en niet aannemelijk is gemaakt dat deze schade ook zonder de normschending zou zijn ontstaan, dan staat het de rechter vrij om met toepassing van de omkeringsregel het conditio sine qua non-verband tussen de normschending en het ontstaan van de schade aan te nemen. Immers, gelet op de bescherming die de geschonden norm beoogt te bieden, is het, behoudens tegenbewijs, redelijk ervan uit te gaan dat als het gevaar waartegen de norm bescherming beoogt te verbieden zich heeft verwezenlijkt, zulks een gevolg moet zijn geweest van deze normschending. De ratio van de omkeringsregel brengt mee dat de onzekerheid omtrent het exacte verloop van de gebeurtenissen voor risico komt van degene die de desbetreffende norm heeft geschonden zodat dat verloop in die gevallen in zoverre niet door de benadeelde behoeft te worden gesteld en, in geval van betwisting, bewezen.
