HR 27 mei 1988, NJ 1989, 29 Staat/Daalder (Veenbroei) - Arrest

Casus
Op 15 juni 1980 zakte de toen 5 jarige Michiel Daalder op een dijksgebied (eigendom en beheer van de Staat) met zijn rechterbeen in de bodem, waardoor hij als gevolg van de veenbroei tweedegraads-verbrandingen opliep.  
Het dijksgebied is niet bestemd als recreatiegebied maar wordt door de Staat gedoogd.
De vraag die centraal staat: heeft de Staat onzorgvuldig en daarmee onrechtmatig gehandeld jegens Michiel Daalder door na te laten met name ter plaatse een of meer borden te zetten waarop tegen het gevaar van veenbroei werd gewaarschuwd?

Rechtbank
De vader van Michiel Daalder eiste schadevergoeding van de Staat. De Rechtbank oordeelde dat de Staat voor de gevolgen van het ongeluk niet aansprakelijk was, omdat wie buitendijks gebied wil betreden ervan bewust moet zijn dat dit gevaren meebrengt. Dat er geen borden waren geplaatst is niet onzorgvuldig.
 
Hof
Daalder ging in hoger beroep bij het Hof. Deze oordeelde dat de Staat wel onrechtmatig had gehandeld door na te laten hetzij de toegang tot de schor te verbieden hetzij een waarschuwingsbord te plaatsen.

Hoge Raad
Gaat met het Hof mee. "Degene die zorg voor een terrein heeft, handelt in strijd met hetgeen volgens het ongeschreven recht in het maatschappelijke verkeer betaamt, wanneer hij, terwijl hij moet verwachten dat het publiek dit terrein zal betreden en weet dat  zich op dit terrein een voor het publiek niet steeds waarneembaar gevaar als het onderhavige voordoet, dat aan het publiek niet bekend is, niettemin nalaat maatregelen te nemen zoals een ter plaatse kenbaar verbod het terrein te betreden of waarschuwing voor dit gevaar. Zulks wordt niet anders wanneer zich op dit terrein ook ander, wel aan het publiek bekende gevaren voordoet".
Deze norm richt zich dus tot ieder die zorg heeft, het maakt niet uit of het een overheidslichaam is of niet.

This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution.     • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
