Casus
In de jaren 80 van de vorige eeuw is tussen de huurder en vehuurder een mondelinge huuroveenkomst gesloten betreffende een onroerende zaak in Zoetermeer. Impala exploiteert daar een werkplaats/garagebedrijf en een showroom. Daar wordt ook een nevenvestiging van Impala onder de naam Low Budget Cars gedreven. In 1993/1995 zijn er twee nabij het gehuurde gelegen percelen in gebruik gegeven. Impala c.s. hebben op de grond de occasions van Low Budget Cars gestald. De gemeente Zoetermeer heeft plannen voor herontwikkeling van het gebied waarin de objecten in kwestie liggen. Een poging tot onteigening is mislukt. Het betreft vooral de vraag of ook ten aanzien van de twee later in gebruik genomen percelen geldt, dat Impale c.s. die ten titel van huur in gebruik hebben. Impala c.s. verdigen dat het zo zou zijn omdat door hen een onderhoudsverplichting ten aanzien van deze objecten zou zijn aanvaard, en daarmee een tegenprestatie zoals bedoeld in art. 7:201 lid 1 BW.
Hoge Raad
Uit dit arrest volgt dat dit afhankelijk is van de inhoud en de strekking van de betreffende afspraak.
