Casus
Land van Rode verhuurt sinds maart 2001 een etagewoning in Kerkrade aan huurster Siedow. Huurster woonde in de woning samen met haar meerderjarige zoon. Op 2 oktober 2001 heeft de meerderjarige zoon van de huurster de huismeester op de parkeerplaats van het woningencomplex mishandeld. De huurster wist niks van de mishandeing en had met deze mishandeling ook niets van doen. Als gevolg van de mishandeling liep de huismeester letsel op en was hij meer dan zeven maanden arbeidsongeschikt. Hierdoor wou de verhuurder de huurovereenkomst beëindigen omdat er sprake was van niet goed huurderschap.
Hoge Raad
Beslissend is in dit verband of de huurder zich, in het licht van de gedragingen van die persoon, zelf niet heeft gedragen als een goed huurder. Bij de beoordeling van deze vraag dient de rechter rekening te houden met alle omstandigheden van het geval, zoals de vraag of er voldoende verband bestaat tussen die gedragingen en het gebruik van het gehuurde. Daarvan kan in elk geval sprake zijn indien de huurder van die gedragingen op de hoogte was of daarmee ernstig rekening had te houden en vervolgens nagelaten heeft maatregelen te treffen die redelijkerwijs van hem verlangd hadden mogen worden.
