Casus
De vereniging Vliegclub Schiphol te Haarlemmermeer en vijf anderen (eisers) hebben gevraagd aan Luchthaven Schiphol N.V. om afschriften te krijgen van goedkeuringsbesluiten van de Raad van Commissarissen over de vaststelling van tarieven over 1991 tot en met 1993. Dit heeft Schiphol geweigerd. Tegen deze weigering hebben de eisers een bezwaarschrift ingediend bij Schiphol. Schiphol heeft op dit bezwaarschrift geen antwoord gegeven. De eisers hebben beroep ingesteld bij de Rechtbank te Haarlem, ter zake van het achterwege blijven van een antwoord op het bezwaarschrift. De Rechtbank heeft de eisers niet-ontvankelijk verklaard, omdat Schiphol geen bestuursorgaan is en zodoende geen besluiten kan nemen in de zin van artikel 1:3 lid 1 Awb. Vervolgens zijn de eisers in hoger beroep gegaan bij de Afdeling Bestuursrecht-spraak Raad van State.
Rechtsvraag
Is Luchthaven Schiphol N.V. een bestuursorgaan in de zin van artikel 1:1 lid 1 Awb?
Afdeling bestuursrechtspraak Raad van State
De eisers hebben voldoende belang om gegevens te verkrijgen over de vaststelling van de tarieven van Schiphol. Op grond van artikel 8:1 Awb kan een belanghebbende een beroep instellen bij de Rechtbank tegen een besluit. Artikel 1:3 lid 1 Awb omschrijft onder andere dat een besluit een schriftelijke beslissing van een bestuursorgaan is. Artikel 1:1 lid 1 Awb omschrijft bestuursorganen: a. een orgaan van een rechtspersoon die krachtens publiekrecht is ingesteld, of b. een ander persoon of college, met enig openbaar gezag bekleed. Luchthaven Schiphol is een N.V. in de zin van boek 2 BW. Schiphol is dus geen rechtspersoon die krachtens publiekrecht is ingesteld. Artikel 1:1 lid 1 sub a Awb is in casu niet van toepassing. Valt Schiphol onder de omschrijving van artikel 1:1 lid 1 sub b Awb? Dit is het geval wanneer (1) de overheid een zodanige invloed heeft op het handelen van een privaatrechtelijke rechtspersoon, dat zij in wezen als een onderdeel van de openbare dienst moet worden beschouwd; of (2) er sprake is van de uitoefening van een incidentele bestuursbevoegdheid. In casu dient punt (1) buiten beschouwing te blijven. Aan punt (2) wordt niet voldaan. In casu is Schiphol dan ook geen bestuursorgaan in de zin van artikel 1:1 lid 1 Awb.
Conclusie
De Afdeling bestuursrechtspraak van de Raad van State bevestigt dus de aangevallen uitspraak en veroordeelt de appellanten (gezamenlijk) de gemaakte kosten door Schiphol bij de behandeling in Hoger Beroep te betalen.
