SBA c.s./Dillema c.s.
In dit geding hebben Dillema V.O.F., Dillema en Dillema-Brandsma (hierna: Dillema c.s.) vorderingen ingesteld, die ertoe strekken dat een einde wordt gemaakt aan het – naar zij stellen: door hen gedoogde – gebruik dat hun buren, Stichting Beheer en Administratie Noord-Oost Friesland en Autohandel Twijzel (hierna SBA c.s.), maken van een pad (de zgn. ‘reed’) dat deel uitmaakt van het perceel van Dillema c.s.
Het hof heeft de vordering toegewezen onder verwerping van het verweer dat sprake is van een ‘buurweg’ in de zin van artikel 719 BW (oud), die slechts met gezamenlijke toestemming van de gebruikers kan worden verlegd, vernietigd of gebezigd tot een ander gebruik dan waarvoor deze was bestemd. Het hof overwoog daartoe onder meer dat uit het enkele gedogen door Dillema c.s. van het gebruik van de reed tot 1 januari 1992, geen stilzwijgende bestemming van de reed tot buurweg kan worden afgeleid.
Volgens de Hoge Raad heeft het hof op zichzelf terecht overwogen dat het enkele gedogen door of vanwege de eigenaar van een weg van het gebruik daarvan door een buurman, nog niet meebrengt dat de weg tot buurweg wordt bestemd. In dit geding hebben SBA c.s. zich echter erop beroepen dat Dillema c.s. de reed stilzwijgend tot buurweg hebben bestemd. Indien het hof heeft geoordeeld dat langdurig gemeenschappelijk gebruik van een weg door buren steeds moet worden aangemerkt als een enkel gedogen, heeft het zich op een onjuiste rechtsopvatting gebaseerd. Indien het hof van een juiste rechtsopvatting is uitgegaan, maar van oordeel was dat van een stilzwijgende bestemming tot buurweg in het onderhavige geval niet kan worden gesproken, is zijn arrest in zoverre onbegrijpelijk gemotiveerd, in aanmerking genomen dat SBA c.s. de reed in ieder geval sinds 1984 in gebruik hebben en dat zij zich mede hierop hebben beroepen. Ongestoord bezit van het recht van buurweg – dat wil zeggen: dat een buurman, of iemand die op grond van zijn rechtsverhouding met die buurman bevoegd is tot gebruik van diens erf, de, naar verkeersopvattingen te beoordelen, feitelijke macht over de desbetreffende weg uitoefent die past bij het gebruik van die weg als buurweg – levert immers het, voor tegenbewijs vatbare, vermoeden op dat van (een bestemming tot) een buurweg sprake is.
