Het beginsel ‘ne bis in idem’, dat is neergelegd in artikel 54 van de Overeenkomst ter uitvoering van het Schengenakkoord (hierna: SUO), moet toepassing vinden op een in een overeenkomstsluitende staat ingeleide strafrechtelijke procedure wegens feiten waarvoor de betrokkene reeds in een andere overeenkomstsluitende staat is veroordeeld, zelfs al was deze overeenkomst in deze laatste staat nog niet van kracht op de datum van uitspraak van die veroordeling, voorzover de overeenkomst in de betrokken overeenkomstsluitende staten van kracht was op het tijdstip van de beoordeling van de toepassingsvoorwaarden inzake het beginsel ne bis in idem door de instantie waarbij de tweede procedure werd ingeleid.
In tegenstelling tot artikel 14 lid 7 IVBPR en artikel 4 van Protocol nr. 7 bij het EVRM, waarin het beginsel ne bis in idem is neergelegd en het begrip ‘strafbaar feit’ wordt gehanteerd, moet artikel 54 SUO zo worden uitgelegd dat het relevante criterium voor de toepassing van dit artikel ‘de gelijkheid van de materiële feiten’ is, begrepen als
- het bestaan van een geheel van feiten die onlosmakelijk met elkaar verbonden zijn,
- ongeacht de juridische kwalificatie van deze feiten of
- het beschermde rechtsbelang.
Wat de gelijkheid van de materiële feiten betreft, is het aan de bevoegde nationale instanties om uiteindelijk te bepalen of de in geding zijnde materiële feiten een geheel van feiten vormen die onlosmakelijk met elkaar verbonden zijn naar tijd en plaats en wat het voorwerp ervan betreft.
Bijgevolg dienen strafbare feiten (hier: uitvoer en invoer van dezelfde verdovende middelen) waarvoor in verschillende staten die partij zijn bij de SUO vervolging is ingesteld, in beginsel te worden beschouwd als ‘dezelfde feiten’ in de zin van dit artikel 54 SUO, maar het is aan de bevoegde nationale instanties om dit uiteindelijk te beoordelen.
