Feiten:

Bij een bank komt een fraudezaak aan het licht. De arbeidsovereenkomsten van eisers worden  op neutrale gronden beëindigd door middel van een ontbindingsprocedure bij de kantonrechter.

Op 12 februari 1997 doet de bank formeel aangifte bij de politie wegens fraude, de aangifte is onder meer gericht tegen eisers. Eisers hebben inmiddels een nieuw bedrijf opgericht. De door eisers benodigde vergunning wordt door de Stichting Toezicht Effectenverkeer geweigerd. Op 9 november 1998 zijn eisers door de politie aangehouden.

Op 21 december 2001 zijn eisers door de strafrechter vrijgesproken van valsheid in geschrifte en verduistering. De Officier van Justitie besluit het ingestelde hoger beroep in de strafzaak in te trekken.

Eisers vorderden in de onderhavige procedure hoofdelijke veroordeling van de Staat en de bank tot betaling van schadevergoeding op grond van onrechtmatige daad en, wat betreft de bank, ter zake van een toerekenbare tekortkoming in de nakoming van de verbintenis uit hoofde van de arbeidsovereenkomst.

Rechtsregel:

De vordering is verjaard. De verjaringstermijn neemt een aanvang op de dag van de aanhouding en gaat niet pas lopen als de uitspraak van de strafrechter onherroepelijk is. Eisers kunnen namelijk van meet af aan zelf beoordelen of de verdenking waarop de strafvervolging was gebaseerd terecht was.

Bovendien kunnen de brieven die door de advocaat van eisers op 10 januari 2002 aan de hoofdofficier van justitie te Amsterdam en op 22 februari 2002 aan de advocaat-generaal bij het gerechtshof te Amsterdam zijn geschreven, om tot een intrekking van het hoger beroep tegen het strafvonnis te komen, niet worden aangemerkt als een stuitingshandeling.
