Casus:
Is er tussen partijen zonder samenlevingsovereenkomst een gemeenschappelijk vermogen ontstaan door het aangaan van effectenrekeningen op beider naam? Het hof oordeelde dat de saldi op de effectenrekening aan de vrouw in eigendom toebehoren, omdat ook de inleg op deze rekeningen van de vrouw afkomstig is. Het enkele feit dat de rekening op beider naam stond, maakte het oordeel van het hof niet anders. Het hiertegen gerichte cassatiemiddel neemt tot uitgangspunt dat het saldo van de effectenrekening en de waarde van de effectenportefeuille in een – al dan niet stilzwijgend tot stand gekomen – contractuele gemeenschap vielen, waarin ieder der partijen deelgerechtigd was. Het bepaalde in artikel 3:166 lid 2 BW brengt vervolgens mee, aldus het middel, dat de aandelen van de man en de vrouw als deelgenoten in een gemeenschap gelijk zijn, tenzij uit hun rechtsverhouding anders voortvloeit. Nu van dit laatste niet is gebleken, is de beslissing van het hof om de vordering van de man af te wijzen, volgens het middel onjuist, althans onbegrijpelijk.
Hoge Raad:
Het middel miskent dat het hof heeft overwogen dat een gemeenschap van goederen niet is overeengekomen. Het beroep wordt verworpen.
