Over internationaal privaatrecht

  • Internationaal privaatrecht is het rechtsgebied dat bepaalt welk recht van toepassing is in een grensoverschrijdende juridische zaak. Dit kan bijvoorbeeld gaan om een contract met een buitenlandse partij, een echtscheiding tussen partners uit verschillende landen of een ongeval in het buitenland. Het doel van internationaal privaatrecht is om rechtszekerheid te creëren en te voorkomen dat er conflict van wetten ontstaat.

1 Inleiding

1.1 Internationaal privaatrecht

Bestaansvoorwaarden

Er zijn twee redenen die verklaren waarom er behoefte is aan internationaal privaatrecht (afgekort ipr). De eerste reden is dat het privaatrecht in elk land verschillend is. Er worden weliswaar pogingen ondernomen om bepaalde rechtsgebieden te harmoniseren maar het is niet mogelijk, en niet wenselijk, om een wereldwijd uniform rechtsstelsel tot stand te brengen. De tweede reden is dat het regelmatig voorkomt dat rechtshandelingen en rechtsfeiten zich niet beperken tot het grondgebied van een land. Grensoverschrijdende rechtsverhoudingen zijn door de globalisering al lang geen exceptie meer.
