Casus
Een pastoor besluit om iedere ochtend om 7:15 de klokken te luiden om omwonende gelovigen te attenderen op het op hande zijnde gebed. Het geluid wat hierbij ontstaat is harder dan is toegestaan op basis van de plaatselijke APV. Omwonenden storen zich hieraan en dringen aan ophandhaving van de desbetreffende APV. De pastoor verweert zich door te stellen dat tde APV in strijd is met art. 6 EVRM en art. 10 Wet openbare manifestaties.
ABRvS
Stelt de pastoor in het ongelijk. Art. 6 EVRM stelt dat buiten gebouwen of besloten plaatsen regels gesteld kunnen worden ter bescherming van de gezondheid, in het belang van het verkeer en ter bestrijding en voorkoming van wanordelijkheden. Art. 10 Wet openbare manifestaties stelt vast dat klokgelui is toegestaan, maar dat er regels kunnen worden gesteld als het gaat om de duur en het geluidsniveau. Tussen 23:00 en 07:30 genieten de meeste mensen van hun nachtrust. Deze periode is geen beperking van de geloofsbelijdenis.
