Casus:

Een verkoper is met de koper overeengekomen dat hij na de overdracht het verkochte appartementsrecht als huurder mag blijven bewonen. Vervolgens vestigt de koper een hypotheek waarin de huurovereenkomst wordt verzwegen en waarin een huurbeding wordt opgenomen. De hypotheekhouder verkoopt het appartementsrecht aan Metterwoon en Metterwoon vordert ontruiming van het appartement met het oog op het huurbeding. De vraag is of het huurbeding, gemaakt door de hypotheekhouder, prevaleert boven een ten tijde van de vestiging van de hypotheek bestaande huurverhouding welke huur de vorige eigenaar zich bij de verkoop en overdracht aan de hypotheekgever had “voorbehouden”.

Rechtsregel:

Een verkoper die met de koper is overeengekomen dat hij na de overdracht de verkochte woning als huurder mag blijven bewonen en vervolgens ook nog meewerkt aan een transportakte waarin uitdrukkelijk wordt vermeld, dat de woning niet vrij van huur wordt overgedragen, mag erop vertrouwen dat de koper/ verhuurder niet alsnog zijn rechten uit de huurovereenkomst kan frustreren door een hypotheek met huurbeding te vestigen. Het belang van de verkoper/ huurder om niet in dit vertrouwen te worden beschaamd, moet zwaarder wegen dan dat van de hypotheekhouder die uit de transportakte heeft kunnen opmaken dat er een eerdere huurovereenkomst was, maar dit onvoldoende heeft onderzocht.
