Artikel 29 lid 5 van richtlijn 71/305/EEG van de Raad
In dit arrest gaat het om de vierde vraag. Met de vierde vraag moet worden beantwoord of een overheidsinstantie, daarmee ook bedoeld een gemeentelijke instantie, evenals de nationale rechter, verplicht is om artikel 29 lid 5 van richtlijn 71/305/EEG van de Raad toe te passen en bepalingen van nationaal recht die daarmee niet verenigbaar zijn, buiten toepassing te laten.
In eerdere uitspraken heeft het Hof genoemd dat in alle gevallen dat wanneer de bepalingen van een richtlijn inhoudelijk gezien onvoorwaardelijk en voldoende nauwkeurig zijn, particulieren zich voor de nationale rechter op die bepalingen kunnen beroepen tegenover de Staat. Wanneer er door de staat is verzuimd de richtlijn binnen de juiste termijn om te zetten naar nationaal recht of dit op een onjuiste wijze is gedaan. In de hiervoor gegeven omstandigheden hebben particulieren het recht om zich voor een nationale rechter te beroepen op de bepalingen van een richtlijn. Dit omdat uit die bepalingen voortvloeiende verplichtingen gelden, die gelden voor alle autoriteiten van alle lidstaten.
Wanneer door het Hof gestelde rechtspraak voorwaarden zijn gesteld en vervuld, waaronder particulieren de bepalingen van een richtlijn voor de nationale rechter kunnen inroepen, zijn tevens alle overheidsinstanties, ook gedecentraliseerde overheidsinstanties zoals provincies en gemeenten, gehouden deze bepalingen toe te passen.
