Artikel 2 lid 1 van Richtlijn 2003/6/EG (marktmisbruik) moet als volgt worden uitgelegd: het feit dat een in de tweede alinea van deze bepaling bedoelde persoon die over voorwetenschap beschikt, voor eigen rekening of voor rekening van derden, rechtstreeks of middellijk de financiële instrumenten waarop deze voorwetenschap betrekking heeft, verkrijgt of vervreemdt of tracht te verkrijgen of te vervreemden, houdt in dat deze persoon in beginsel van deze informatie ‘gebruikmaakt’. De vraag of deze persoon het verbod van handel met voorwetenschap heeft overtreden, moet worden onderzocht op basis van de doelstelling van deze richtlijn, die erin bestaat de integriteit van de financiële markten te beschermen en het vertrouwen van de beleggers te vergroten, dat onder meer berust op de wetenschap dat zij met elkaar op voet van gelijkheid zullen verkeren en dat zij zullen worden beschermd tegen het ongeoorloofde gebruik van voorwetenschap.

Artikel 14 lid 1 van deze Richtlijn moet als volgt worden uitgelegd: het economische voordeel dat uit handel met voorwetenschap wordt gehaald, kan een relevante factor zijn bij de vaststelling van een doeltreffende, evenredige en afschrikkende sanctie. De wijze van berekening van dat economische voordeel en de in aanmerking te nemen datum of periode zijn zaak van nationaal recht. Indien een lidstaat de mogelijkheid biedt om naast de in deze bepaling bedoelde administratieve sancties een strafrechtelijke geldelijke sanctie op te leggen, hoeft bij de beoordeling of de administratieve sanctie doeltreffend, evenredig en afschrikkend is, geen rekening te worden gehouden met de mogelijkheid en/of het niveau van een eventuele latere strafsanctie.

When you have found a magazine of your likings, add that page to your favorites so you can easily go to that starting point directly from your profile during future visits. Below you will find some start magazines per field of study
  2. Use the topics and taxonomy terms
    • The topics and taxonomy of the study and working fields gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution. Note: not all content is tagged thoroughly, so when this approach doesn't give the results you were looking for, please check the search tool as back up
  3. Check or follow your (study) organizations:
    • by checking or using your study organizations you are likely to discover all relevant study materials.
    • this option is only available trough partner organizations
  4. Check or follow authors or other WorldSupporters
    • by following individual users, authors  you are likely to discover more relevant study materials.
  5. Use the Search tools
    • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
