Casus
Bij besluit van 16 juli 2004 heeft de burgemeester (hierna: de appellant)vergunningen verleend voor de exploitatie van twee coffeeshops in het pand aan de Bevrijdingsweg 16 te Venlo. Ten gevolge van dit besluit heeft de eigenaar van een nabijgelegen woning (hierna: de verzoeker) op 7 februari 2005 een verzoek ingediend om compensatie van schade door waardevermindering (nadeelcompensatie). De appellant heeft het bezoek aangemerkt als een herhaald verzoek en met toepassing van artikel 4:6 lid 2 Awb afgewezen omdat in de besluiten van 16 juli 2004 al aandacht is besteed aan mogelijk onevenredig nadeel van directe omwonende en de rechtmatigheid van die besluiten vaststaat. Appellant stelt dat de het besluit tot vergunning mede een onzuiver schadebesluit inhoud. Waardoor het verzoek tot een zuiverschade besluit moet worden afgewezen.

Appellant heeft ten onrechte het verzoek tot nadeelcompensatie als een herhaald verzoek aangemerkt. Ook al is er bij de voorbereiding op het besluit van 16 juli 2004 aandacht besteed aan de vraag of mogelijke schade door de besluitvorming in aanmerking moet komen voor vergoeding, maar uiteindelijk heeft appellant in de besluiten van 16 juli 2004 niet over toekenning van nadeelcompensatie aan verzoeker beslist. De Rechtbank oordeelt dat ook al zijn de besluiten van 16 juli 2004 in rechte onaantastbaar en rechtmatig, dit niet in de weg staat aan de mogelijkheid voor de eigenaar van de woning een zuiver schade besluit van de burgemeester uit te lokken.
Commentaar
In deze casus gaat het om de verhouding tussen de gelijkheid van openbare lasten (het egalité-beginsel) en artikel 3.4 lid 2 Awb, de onevenredige schade.
In artikel 3.4 lid 2 Awb wordt uitgegaan van een proportionaliteitstoets, een drieledige toets op geschiktheid, noodzakelijkheid en evenwichtigheid, die de overheid verbied om een besluit of handeling te verrichten waarvan de nadelen onevenredig zijn ten opzichte van de met het besluit te dienen doelen. Toetsing van het egalité-beginsel gaat om de verhouding tussen de nadelen van het besluit voor een beperkte groep van burgers of instelling ten opzichte van de overige leden van de samenleving.
In casu geeft de Afdeling aan dat, ook al is er geen sprake van onevenredige schade in de zin van artikel 3.4 lid 2 Awb, dus het besluit rechtmatig kan worden genomen, er toch aanleiding kan zijn voor een schadevergoeding op grond van het egalité-beginsel.
