Casus

Notaris Pinckers ontslaat zijn notarieel medewerker Dibbets, zonder inachtneming van de toepasselijke opzegtermijn en zonder voorafgaande toestemming aan de toenmalige RDA. Dibbets riep de nietigheid van het ontslag in, verklaarde zich bereidt de bedongen arbeid te verrichten en startte een loonprocedure conform art. 7:628 BW. Korte tijd later werd hem echter een andere baan aangeboden. Dibbets wenste door deze wijziging van de situatie het beroep op de nietigheid van de opzegging in te trekken en in de plaats daarvan gefixeerde schadevergoeding te vorderen. Dit was financieel voordeliger voor hem.

Hoge Raad

Ad 1. De werknemer die niet al direct na het gegeven ontslag eenduidig in beëindiging van de dienstbetrekking toestemt, kan later de nietigheid van het ontslag inroepen.

Ad 2. Heeft de werknemer de nietigheid van het ontslag ingeroepen, dan kan hij daar later op terugkomen. Uitzonderingen hierop zijn onder bijzondere omstandigheden mogelijk; in sommige gevallen kan de werknemer niet terugkomen op het inroepen van de nietigheid. Afstand van het beroep op de nietigheid vindt plaats als tegenover de werkgever ondubbelzinnig afstand wordt gedaan.

Ad 3. Dan beëindigt het onregelmatig ontslag de dienstbetrekking alsnog per de aangezegde ontslagdatum. De werkgever wordt als gevolg van art. 7:677 BW (1639a oud) schadeplichtig. Ook van zijn aanspraak daarop kan de werknemer afstand doen, maar daartoe is een duidelijke en ondubbelzinnige, op déze afstand gerichte verklaring van de werknemer vereist.
