Rechtsregel
Een verplichting tot levering, welke ingevolge een overeenkomst van koop en verkoop op de verkoper komt te rusten, zo daaraan tijdens het leven van de verkoper niet is voldaan, gaat na diens overlijden op zijn erven over.
Aan die overgang doet niet af de omstandigheid dat het verkochte goed behoort tot een vermogen waarin reeds tijdens het leven van de erflater die erven medegerechtigd waren, zodat de erflater dat goed niet zonder hun medewerking zou hebben kunnen leveren en een veroordeling van de erflater tot nakoming dan ook niet voor tenuitvoerlegging vatbaar zou zijn geweest.
De omstandigheden waaronder en de toeleg waarmee een dergelijke overeenkomst tot stand kwam, kunnen meebrengen dat deze een geoorloofde oorzaak mist.
Aan de overgang op de erfgenamen van de op de erflater rustende verplichting tot levering staat niet in de weg dat de erflater ten gevolge van het vorenbedoeld gebrek in zijn beschikkingsbevoegdheid niet in staat zou zijn geweest aan de koper de eigendom van het gekochte goed te verschaffen.
