Om vast te stellen of een ondernemer wiens activiteit op zijn internetsite of die van een tussenpersoon wordt voorgesteld, kan worden geacht zijn activiteit ‘te richten’ op de lidstaat waar de consument woonplaats heeft in de zin van artikel 15 (1) (c) Brussel I Vo., dient te worden nagegaan of vóór de eventuele sluiting van een overeenkomst met de consument uit deze internetsites en de algemene activiteit van de ondernemer blijkt dat deze van plan was om handel te drijven met consumenten die woonplaats hebben in één of meerdere lidstaten, waaronder die waar deze consument woonplaats heeft, in die zin dat hij bereid was om met deze consumenten een overeenkomst te sluiten.
De volgende factoren, waarvan de lijst niet uitputtend is, kunnen aanwijzingen vormen dat de activiteit van de ondernemer is gericht op de lidstaat waar de consument woonplaats heeft:
- het internationale karakter van de activiteit,
- routebeschrijvingen vanuit andere lidstaten naar de plaats waar de ondernemer is gevestigd,
- het gebruik van een andere taal of munteenheid dan die welke gewoonlijk worden gebruikt in de lidstaat waar de ondernemer gevestigd is en de mogelijkheid om in die andere taal de boeking te verrichten en te bevestigen,
- de vermelding van een telefoonnummer met internationaal kengetal,
- uitgaven voor een zoekmachineadvertentiedienst die worden gemaakt om consumenten die in andere lidstaten woonplaats hebben, gemakkelijker toegang te verlenen tot de site van de ondernemer of diens tussenpersoon,
- het gebruik van een andere topleveldomeinnaam dan die van de lidstaat waar de ondernemer gevestigd is en
- de verwijzing naar een internationaal clientèle bestaande uit klanten die woonplaats hebben in verschillende lidstaten.
Het staat aan de nationale rechter om na te gaan of deze aanwijzingen voorhanden zijn.
De loutere toegankelijkheid van de internetsite van de ondernemer of de tussenpersoon in de lidstaat waar de consument woonplaats heeft, is daarentegen onvoldoende.
Hetzelfde geldt voor de vermelding van een e‑mailadres en andere contactgegevens of voor het gebruik van een taal of een munteenheid wanneer deze taal en/of munteenheid gewoonlijk worden gebruikt in de lidstaat waar de ondernemer gevestigd is.
