Casus
Eiseres E, vriendin van de erflater, vordert afgifte van het legaat van huur van de woning tegen een huurprijs van bedrag X. Gedaagde G, zoon van de erflater, voert hiertegen aan dat een huurrecht niet gelegateerd kan worden, omdat het huurrecht niet behoort tot het vermogen van de legataris.
Rechtsregel
Dit standpunt van G is onjuist. Volgens artikel 4:117 lid 1 BW is een legaat een uiterste wilsbeschikking waarin de erflater aan een of meer personen een vorderingsrecht toekent. Niet valt in te zien dat dit vorderingsrecht geen recht van huur zou kunnen zijn van een woning welke tot de nalatenschap behoort.
Voor zover G heeft willen betogen dat het aan E gelegateerde huurrecht niet tot de nalatenschap behoort en het legaat daarmee op grond van artikel 4:49 lid 1 BW is vervallen, geldt het volgende.
Het huurrecht van de woning behoort, althans ten dele, niet tot de nalatenschap aangezien de woning tot de huwelijksgoederengemeenschap van erflater en zijn vrouw M behoorde. Op grond van artikel 4:49 lid 1 BW vervalt het legaat desondanks niet wanneer uit de uiterste wil zelf is af te leiden dat de erflater de beschikking niettemin heeft gewild. In het onderhavige geval is daarvan sprake.
G heeft verder aangevoerd dat M, als langstlevende echtgenoot, een verzoek als bedoeld in artikel 4:29 BW heeft gedaan waardoor feitelijke afgifte van het legaat niet mogelijk is. E heeft betwist dat M recht heeft op vruchtgebruik van de woning op grond van deze bepaling, omdat zij ten tijde van het overlijden van de erflater niet woonachtig was in de woning. G heeft bevestigd dat er (nog) geen recht van vruchtgebruik op de woning rust ten gunste van M. Nu G hieromtrent ook niets anders heeft gesteld moet ervan uitgegaan worden dat de woning valt in de niet verdeelde huwelijksgoederengemeenschap, dat de woning voor de helft behoort tot de niet verdeelde nalatenschap van erflater en voor de helft eigendom is van M als langstlevende echtgenoot en dat er geen rechthebbende is op het gebruik van de woning.
Op grond van artikel 4:51 lid 1 BW kan E onder deze omstandigheden het recht van huur van de woning van G als enig erfgenaam vorderen. Voor zover het gebruik van de woning bij de verdeling van de huwelijksgoederengemeenschap aan M zou zijn toebedeeld, zou G kunnen volstaan met uitkering van de waarde van het huurrecht aan E. G heeft echter niet gesteld dat het gebruik van de woning is toegevallen aan M. Verder is er geen recht op vruchtgebruik op de woning gevestigd ten gunste van M. Er zijn derhalve geen belemmeringen die in de weg staan aan afgifte aan E van het legaat in de vorm van verlening van een huurrecht op de woning.
