Casus
De overheid heeft boer Leffers lange tijd een vergunning gegeven voor het voederen van zijn varkens met slachtafval (zogenaamde swill). Naar aanleiding van een geval van Afrikaanse varkenspest, wordt die vergunning met onmiddellijke ingang ingetrokken, op grond van de (ministeriële) Regeling verbod voedsel- en slachtafvallen (varkens).
Boer Leffers was volledig op slachtafval aangewezen, en komt dus in de problemen. Zijn bedrijf failleert. Leffers eist vervolgens in rechte schadevergoeding en buiten werking stellen van de Regeling.
Hoge Raad
De Regeling kan niet buiten werking worden gesteld, gelet op de buitengewoon zwaarwegende belangen (voorkomen epidemie) die ermee gemoeid zijn. De Regeling heeft ten onrechte geen voorziening getroffen die het de kleine groep van bedrijfsmatige varkensmesters die geheel afhankelijk waren van het slachtafval, hetzij financieel mogelijk had gemaakt hun bedrijf aan te passen hetzij anderszins financieel tegemoet was gekomen. Dat levert t.o.v. die groep een onrechtmatige daad op, op grond waarvan de Staat schade moet vergoeden. Leffers behoort tot die groep.
