Heeft de verdachte ter zake van medeplegen van deelneming aan een rechtspersoon die tot oogmerk heeft het plegen van misdrijven (140 Sr.).
Hoge Raad
- Niet nodig is het dat de rechtspersoon beoogt de misdrijven zelf te plegen, ook uitlokking of medeplichtigheid is mogelijk van door anderen te plegen misdrijven
- het begrip rechtspersoon in art. 140 Sr is een ruimer begrip dan het civielrechtelijke begrip rechtspersoon
- het is niet nodig dat de wil aanwezig is om lid te zijn van een vereniging; het gaat erom dat in feitelijke zin wordt deelgenomen aan een gestructureerd (gedurende langere tijd, continuïteit) samenwerkingsverband dat tot oogmerk heeft het plegen van misdrijven
- stelt niet de eis dat dit samenwerkingsverband naar buiten toe als eenheid optreedt
- medeplegen van art. 140 Sr. is mogelijk, indien er sprake is van bewuste samenwerking.
De HR verwerpt het beroep.
