Boze buurman (HR 21-11-2006, LJN AX9177; NJ 2006, 650)
Casus
Verdachte stond ’s nachts met twee vrienden voor het huis van zijn buurman te praten. Deze buurman kwam vervolgens naar buiten om te zeggen dat zij weg moesten gaan. Bij het weglopen heeft verdachte de buurman uitgescholden. De buurman werd daarop erg boos, riep ‘oprotten sukkels’ en kwam de jongens achterna. Hij heeft hen daarbij in het nauw gedreven. Verdachte heeft daarbij geprobeerd de buurman te kalmeren. Toen dat niet lukte, heeft hij hem een vuistslag gegeven. Het hof verwerpt het beroep op noodweer omdat onvoldoende aannemelijk is geworden dat de verdachte zich niet door weg te lopen aan de door hem als bedreigend ervaren situatie kon onttrekken, hoewel daartoe de gelegenheid bestond.
Hoge Raad
De vraag of ook dan een feit als geboden door de noodzakelijke verdediging van eigen of eens anders lijf, eerbaarheid of goed kan worden aangemerkt, indien de verdachte een voor hem bestaande gelegenheid om zich door verwijdering aan de aanval te onttrekken, onbenut heeft gelaten, is niet vatbaar voor beantwoording in algemene zin. Bij de beslissing daaromtrent komt mede betekenis toe aan de waardering van de feitelijke omstandigheden van het geval.
Mede in het licht van hetgeen door en namens de verdachte is aangevoerd en steun vindt in de door de raadsman aangehaalde verklaringen van betrokkenen, inhoudende dat het latere slachtoffer zich agressief jegens de verdachte gedroeg terwijl deze hem juist tot kalmte probeerde te manen, is het oordeel van het hof niet zonder meer begrijpelijk.
De Hoge Raad vernietigt de bestreden uitspraak en wijst de zaak terug opdat de zaak op het bestaande hoger beroep opnieuw wordt berecht en afgedaan.
