Casus

Salduz-problematiek. Het middel klaagt dat het Hof de verklaring van de verdachte bij de politie bij de bewijsvoering heeft betrokken, terwijl hij voorafgaand aan het verhoor niet in de gelegenheid was gesteld een advocaat te raadplegen. Niet blijkt dat deze klacht aan het Hof is voorgelegd en zo’n verweer kan niet voor het eerst in cassatie worden gevoerd.

Hoge Raad

Het middel behelst de klacht dat het Hof — in strijd met het recht op een eerlijk proces als bedoeld in art. 6 EVRM — de verklaring die de verdachte op 24 augustus 2006 bij de politie heeft afgelegd zonder dat hij voorafgaand aan het verhoor in de gelegenheid was gesteld een advocaat te raadplegen, bij de bewijsvoering heeft betrokken. Uit de stukken blijkt echter niet dat deze klacht aan het Hof is voorgelegd. Zo een verweer kan niet voor het eerst in cassatie worden gevoerd, aangezien de beoordeling daarvan een onderzoek van feitelijke aard zou vergen (r.o. 3.2). Het middel faalt.

Vraag 1

Welk strafvorderlijk voorschrift of rechtsbeginsel is in deze zaak geschonden?

Stel: een medeverdachte van de verdachte die in deze zaak terecht staat is door de politie verhoord zonder dat hij tevoren in de gelegenheid is gesteld een advocaat te raadplegen. Die medeverdachte heeft daarin bekend dat hij en de verdachte zich schuldig hebben gemaakt aan het medeplegen van schuldheling. Kan het proces-verbaal waarin de opgave van de medeverdachte is neergelegd worden gebruikt voor het bewijs in de zaak tegen de verdachte?

Antwoordindicatie

Vraag 1

In deze zaak is het recht op rechtsbijstand geschonden (r.o. 2.5 en 2.7.1). Dit recht is ontleend aan art. 6 EVRM, maar staat tegenwoordig in art. 28 lid 1 jo. 28c en 28d Sv. De HR oordeelde hierover dat een dergelijk vormverzuim dient te leiden tot uitsluiting van het bewijs van de verklaringen van de verdachte die zijn afgelegd voordat hij een advocaat kon raadplegen (r.o. 2.7.2) en van bewijsmateriaal dat als rechtstreeks gevolg daarvan is verkregen (r.o. 2.7.3). Dit valt dus in categorie 1 van het arrest ‘Criteria toepassing bewijsuitsluiting’.

Vraag 2

Ja, het bewijs mag tegen de verdachte worden gebruikt, aangezien de verdachte niet zelf was getroffen in het belang dat de overtreden norm beoogt te beschermen (Schutznorm). Het geschonden belang is het recht op consultatiebijstand (art. 6 EVRM). Alleen het belang van de medeverdachte is hierdoor getroffen.
