Casus
De vriend van verdachte verbreekt de relatie. Zij gaat, na alcohol gedronken te hebben, tegen middernacht naar diens huis om hem hierover ter verantwoording te roepen. Er ontstaat ruzie. Verdachte pakt een in het huis liggend mes en steekt haar ex-vriend dood. Zij wordt vervolgd wegens doodslag. De vrouw doet een beroep op een schulduitsluitingsgrond.
Hof
Verdachte heeft zich willens en wetens begeven in een situatie waarin het optreden van een hevige gemoedsbeweging voorspelbaar was en een handeling als de bewezen verklaarde niet denkbeeldig. Het Hof baseert dit op de navolgende zes feiten en omstandigheden: verdachte is een intelligente en geschoolde vrouw waardoor zij wist dat in relationele crisissituaties de afgewezen partner wel eens overgaat tot niet beoogde gewelddadigheid; het slachtoffer had verdachte grof bejegend; uitlatingen van het slachtoffer waardoor zij rekening hield met de mogelijkheid dat het slachtoffer de relatie niet wilde herstellen; de telefonische mededeling van het slachtoffer dat hij geen prijs stelde op haar bezoek; het vond plaats rond middernacht en na alcoholgebruik door verdachte en zij wist dat het slachtoffer zich te buiten ging aan excessief alcoholgebruik. Volgt veroordeling.
Hoge Raad
Het Hof heeft de verweren - die er op neerkomen dat verdachte zou hebben gehandeld onder invloed van een drang waaraan zij redelijkerwijze geen weerstand kon bieden- verworpen op daartoe ondeugdelijke gronden. De vaststelling van het Hof, dat de verdachte zich willens en wetens heeft begeven in een situatie waarin het optreden van een hevige gemoedsbeweging voorspelbaar en een handeling als de bewezen verklaarde 'niet denkbeeldig' was, sluit immers niet de mogelijkheid uit dat verdachte niettemin heeft gehandeld onder invloed van een drang waaraan zij geen weerstand kon bieden zonder zich aan het optreden van een zodanige drang willens en wetens te hebben blootgesteld. Volgt vernietiging en verwijzing van de zaak naar een aangrenzend Hof.
Rechtsoverwegingen
Het Hof meende dat de vrouw zich willens en wetens in de positie heeft gebracht, dat deze situatie in het gebeurde uitmondde. Er is dus sprake van culpa in causa. De HR is het hier niet mee eens. ‘t Hart concludeert dat eerst moet worden gekeken of er sprake is van een schulduitsluitingsgrond, voordat men aan de zogenaamde culpa in causa toekomt.
