Wat is het verschil tussen echte en juridische problemen? - Chapter 1

In de echte wereld vinden er gebeurtenissen plaats die tot problemen kunnen leiden. Niet elk probleem is echter juridisch. Het hangt er vanaf of er rechtsregels zijn die op concrete feiten toegepast kunnen worden, waardoor het probleem een juridisch probleem wordt en juridisch opgelost kan worden.

1. Hoe zien juristen casussen?

Op een woensdagmiddag rijdt meneer de Vries op zijn scooter over de parallelweg langs de provinciale weg. Hij rijdt met normale snelheid, echter wordt meneer de Vries aangereden door mevrouw van der Putten die rijdt in haar auto. Mevrouw van der Putten had voorrang moeten verlenen, maar deed dit niet. Mevrouw van der Putten geeft haar fout toe, het lijkt een gemakkelijke zaak te worden. En dan blijkt het tegendeel, meneer de Vries overlijdt aan een hartaanval vanwege bestaande hartproblemen.

Hoe ziet de jurist deze casus? Er is sprake van strijd met artikel 15 Reglement verkeersregels en verkeerstekens 1990, een strafbaar feit door het niet verlenen van voorrang. Er is zelfs een mogelijkheid van een ander strafbaar feit, namelijk op grond van artikel 6 Wegenverkeerswet 1994 waarbij een ongeval lijdt tot het overlijden van een van de verkeersdeelnemers. Bovendien is sprake van schade voor de nabestaanden van de overledene, zoals weggevallen inkomsten en kosten voor de begrafenis. Er kan sprake zijn van een onrechtmatige daad, dit is civielrechtelijk. Er zijn dus allerlei mogelijkheden in het geval van een 'normaal' lijkend verkeersongeluk.

2. Hoe denken juristen?

Op grond van bovenstaande casus is het mogelijk om in een geval aansprakelijk te worden gesteld in civiel- en strafrechtelijk opzicht. Het recht bestaat uit meerdere onderwerpen, ieder onderwerp van het recht heeft eigen begrippen, regels en procedures.

    • The topics and taxonomy of the study and working fields gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution. Note: not all content is tagged thoroughly, so when this approach doesn't give the results you were looking for, please check the search tool as back up

    • by checking or using your study organizations you are likely to discover all relevant study materials.
    • this option is only available trough partner organizations
  4. Check or follow authors or other WorldSupporters
    • by following individual users, authors  you are likely to discover more relevant study materials.
  5. Use the Search tools
    • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
    • The search tool is also available at the bottom of most pages
