TentamenTickets: Tips & Tricks bij het voorbereiden op de tentamens
Als er in een vraag op het tentamen geen informatie wordt gegeven over een bepaalde kwestie, dan mag je er vanuit gaan dat het geen probleem oplevert. Staat er bijvoorbeeld niets over betekenen, dan mag je aannemen dat dat goed gegaan is.
Bij strafrecht I is het van belang om de antwoorden op het tentamen uitgebreid te formuleren. Omdat het een inleidend vak is, moeten alle door jou gezette stappen in het antwoord voorkomen, anders kost het je al snel punten.
Maak en ken het onderscheid tussen het materiële strafrecht en het formele strafrecht. Ken ook de bijbehorende vragen.
Bij het materiële strafrecht moet je goed onderscheid kunnen maken tussen de verschillende delictsvormen.
Bij het formele strafrecht moet je vooral de schema’s goed kennen, bijvoorbeeld het culpa-schema. Hier worden bijna altijd vragen over gesteld.
Zorg dat je weet wat elementen en bestanddelen zijn en hoe deze in het strafrecht worden getoetst.
Ken het onderscheid tussen de straf- en schulduitsluitingsgronden, waarbij ook de ongeschreven gronden van belang zijn. Weet vervolgens ook het verschil tussen vrijspraak en ontslag van alle rechtsvervolging.
Als het om sancties gaat (straf/maatregel), kijk dan of alles klopt. Je moet letten op aard, duur/hoogte en combinatie. Kijk ook of er niets vergeten is (bijvoorbeeld het opleggen van vervangende hechtenis in geval van geldboete).
In de werkgroepen ligt het accent op het toepassen van de theorie op praktijkvoorbeelden die zullen lijken op de tentamenvragen. Er is aandacht voor jurisprudentie en oefenvragen; een goede oefening voor het tentamen.
Evenals bij alle andere vakken zorgen de hoorcolleges voor een goede basis voor het tentamen. Enkele vragen op het tentamen worden gemaakt aan de hand van de stof besproken in de hoorcolleges.
Vragen: Een typische tentamenvraag over een casus zal er ongeveer zo uit kunnen zien: “Kan de culpa als bestanddeel van het delict dood door schuld in de zin van art. 6 WVW 1994 worden bewezen? Maak gebruik van het culpa-schema dat is opgenomen in de digitale literatuur- en jurisprudentiebundel. Begin de bespreking van elk onderdeel op een nieuwe regel.”
