Tussen 1959 en 1962 werd een aantal kinderen geboren met afwijkingen, welke waarschijnlijk het gevolg waren van het feit dat hun moeders tijdens de zwangerschap gebruik hadden gemaakt van thalidomide als slaap- of kalmeringsmiddel.
In verband hiermee spanden veel ouders processen aan tegen de fabrikant en verkoper van thalidomide in het Verenigd Koninkrijk: Distillers Company Ltd. In 1972 publiceerde de Sunday Times een artikel getiteld: "Our Thalidomide Children: A cause for national shame" en kondigde aan een artikel te publiceren over de voorgeschiedenis van de tragedie en over de fabricage en het testen van thalidomide tussen 1958 en 1961. Distillers tekende hiertegen protest aan bij de Attorney-General stellend dat genoemd artikel zou leiden tot "contempt of court" i.v.m. de aanhangige civiele procedures.
De Attorney verzocht daarop het High Court een "injunction" uit te vaardigen waarbij de publicatie van het voorgenomen artikel zou worden verboden. Het Hof gaf een dergelijke injunction in 1972. In beroep hief het Court of Appeal de injunction op. In hoger beroep liet het Hoger Huis de injunction weer van kracht worden, omdat het artikel zou leiden dat vooringenomenheid bij het publiek ten aanzien van het tussen de ouders en distillers aanhangige geschil en de daarmee verbonden onderhandelingen voor een schikking. De uitgever Times heeft een klacht ingediend bij de Europese Commissie. De Commissie achtte de klacht ontvankelijk en legde de zaak voor aan het EHRM. Het arrest is beslist met 11 stemmen voor en 9 tegen.
Het woord "wet" in de uitdrukking `Voorzien bij wet/prescribed by law" in art 10 lid 2 EVRM, omvat ook ongeschreven recht zoals het Britse "contempt of court". Dit moet voldoende toegankelijk en duidelijk zijn.
Een beperking van de vrijheid van meningsuiting, welke bij "de wet is voorzien", moet voldoen aan de volgende voorwaarden: ten eerste dient het recht waarop de beperking berust voldoende kenbaar te zijn en ten tweede kan een norm slechts dan beschouwd worden als "wet" wanneer deze met voldoende precisie is geformuleerd, zodat de justitiabele er zich naar kan richten.
Bij de bepaling of een beperking "nodig is in een democratische samenleving" genieten de staten een zekere beleidsvrijheid. Deze is echter niet onbegrensd: het Hof ziet toe op de verenigbaarheid van het nationale beleid met de verdragsverplichtingen. Een zodanig onderzoek reikt verder dan de vaststelling of het beleid van de staat redelijk, zorgvuldig en te goede trouw was.
Een beperking is slechts "nodig in een democratische samenleving indien deze beantwoordt aan een dringende maatschappelijke behoefte, evenredig is aan het wettige nagestreefde doel en indien de ter rechtvaardiging aangevoerde gronden relevant zijn en voldoen aan het gestelde in art 10 lid 2. Hierbij moet rekening worden gehouden met elk aspect van de zaak dat het openbaar belang betreft.
In casu is er sprake van schending van de vrijheid van meningsuiting. Het Hof houdt de beslissing over de schadeloosstelling aan.
