Analyseer paragraaf 60 t/m 65 en noteer aan welke drie vereisten het EHRM toetst om te bepalen of de inbreuk op het familie- en gezinsleven gerechtvaardigd is;
Een kinderbeschermingsmaatregel maakt over het algemeen inbreuk op het recht. Dit mag alleen als er voldaan is aan de voorwaarden in lid 2. Drie voorwaarden:
Inmenging moet bij wet voorzien zijn
Is er een voldoende duidelijke wettelijke regeling? Wet is duidelijk genoeg om aan dat punt te voldoen.
Legitiem doel nastreven
Het belang is vaak het beschermen van de gezondheid van minderjarigen.
Het ingrijpen moet in een democratische samenleving noodzakelijk zijn
Duidelijke noodzakelijkheidstoets en proportionaliteitstoetsing uitgevoerd door EHRM.
Analyseer paragraaf 68 t/m 71 en noteer welk cruciaal element het EHRM hier bespreekt bij de beoordeling van de noodzaak van een uithuisplaatsing.
De noodzaak van een uithuisplaatsing
Staten zijn gehouden diepgaand onderzoek te doen naar mogelijke alternatieven om de uithuisplaatsing te voorkomen.
Dat geldt in het bijzonder voor het geval er geen sprake is van gewelddadig of ander schadelijk gedrag van de ouder.
Dan moet je dus echt kunnen aantonen dat alle andere mogelijke alternatieven diepgaand zijn onderzocht en niet voldoende zijn gebleken. Pas daarna kan uithuisplaatsing gerechtvaardigd zijn.
In dat geval volstaat het niet om enkele, maar niet alle mogelijke alternatieven te onderzoeken.
Contact tussen kind en ouder moet gefaciliteerd worden.
Tijdens het besluitvormingsproces en daarna nog steeds.
