Casus
K. wordt verdacht van betrokkenheid bij vervoer van hashish. Het OM sluit met K. een overeenkomst met de toezegging, dat als K. verklaringen aflegt over zijn rol en over de rol van de andere betrokkenen in de zaak, hij geen gevangenisstraf opgelegd krijgt. Het gaat hier om een getuigenis in het Octopus- proces.
Rechtsvraag
1. Welk gevolg kan de Hoge Raad verbinden aan een overeenkomst die gesloten wordt met een kroongetuige, maar welke overeenkomst later onrechtmatig blijkt?
2. Als een toezegging aan een kroongetuige onrechtmatig is, kan dit gezien worden als
minachting voor de rechter?
Hoge Raad
Ad1. Het hof had het OM niet- ontvankelijk verklaard, omdat het OM de kroongetuige een toezegging had gedaan die in strijd was met de wet (art.553 Sv), namelijk dat aan de getuige geen straf opgelegd zou worden. Door deze toezegging heeft het OM een ernstige inbreuk op de beginselen van een behoorlijke procesorde gedaan. Centraal stond bij de mening van het hof het algemeen belang, namelijk het belang van de gemeenschap bij normhandhaving door middel van berechting. Dat door je te houden aan het wettelijk systeem het algemeen belang gediend wordt, was een mening die door zowel het hof als de Hoge Raad gedeeld werd. Omdat dit gemeenschappelijk belang van zo'n fundamentele aard is, kan schending ervan tot niet- ontvankelijkheid leiden. Ook als dat betekent dat de verdachte geen nadeel ondervonden heeft. Grove of opzettelijke schending van het recht op een eerlijk proces is niet meer de enige voorwaarde voor niet- ontvankelijkheid van het OM.
Ad. Volgens de Hoge Raad heeft het OM geen bevoegdheid om een overeenkomst met een kroongetuige te sluiten en hierdoor heeft het OM de strafvorderlijke verhouding tussen zichzelf en de rechter miskend. De rechter beslist zelfstandig over de straf die opgelegd wordt en het OM heeft de verplichting die beslissing uit te voeren.
