Feiten
Bij besluit van 22 februari 2011 had het college van burgemeester en wethouders van Helmond ontheffing verleend ten behoeve van het realiseren van een zanddepot met ontsluitingsweg voor een periode van vijf jaar op percelen aan de Raktweg in Helmond. Bij uitspraak van 4 mei 2011, heeft de voorzieningenrechter, voor zover thans van belang, het door appellant 1 daartegen ingestelde beroep gegrond verklaard, voor zover dit ziet op het ontbreken van aan de ontheffing verbonden voorschriften.

In de uitspraak komt naar voren dat een rapport dat openbaar beschikbaar was en niet is opgesteld ten behoeve van de voorliggende aanvraag en voor een beoordeling van het ontwerpbesluit ook niet nodig was, hoeft niet met het ontwerpbesluit ter inzage te worden gelegd. Als een wel ten behoeve van de aanvraag opgesteld stuk niet ter inzage wordt gelegd, wordt gehandeld in strijd met artikel 3:11 van de Awb. De betrokkene is daardoor echter niet in zijn belangen geschaad, als hij deze stukken voorafgaand aan de zitting bij de rechtbank alsnog heeft ontvangen en deze stukken in zijn beroepsgronden heeft betrokken. Als niet aannemelijk is dat andere belanghebbenden hebben afgezien van het naar voren brengen van zienswijzen omdat het desbetreffende stuk niet met het ontwerp ter inzage lag, kan dit gebrek met toepassing van artikel 6:22 van de Awb worden gepasseerd.
Het niet ter inzage leggen van het bestreden besluit, zoals bepaald in artikel 3:44 lid 1 Awb, heeft betrekking op een onregelmatigheid die dateert van na het nemen van het besluit, waardoor het reeds om die reden de rechtmatigheid van dit besluit niet kan aantasten.
Om dezelfde reden kan ook het argument dat van dat besluit ten onrechte niet langs elektronische weg kennisgeving is gedaan en dat besluit ten onrechte nog steeds niet langs elektronische weg beschikbaar is gesteld, geen doel treffen.
