De Staat heeft in juli 2008 in het 'Besluit uitvoering rookvrije werkplek, horeca en andere ruimten' horeca-inrichtingen verplicht maatregelen te nemen zodat bezoekers en werknemers geen rookoverlast ondervinden. Per 6 juli 2011 is er een uitzondering op deze verplichting gemaakt voor kleine cafés zonder personeel.
De Nederlandse Nietrokersvereniging CAN was echter van mening dat deze versoepeling in strijd was met de WHO Framework Convention on Tobacco Control (WHO Kaderverdrag). CAN is een procedure gestart en heeft o.a. een verklaring voor recht gevorderd dat de Staat onrechtmatig handelt jegens haar en de personen wiens belangen zij behartigt. De gemaakte uitzondering zou in strijd zijn met art. 8 lid 2 WHO Kaderverdrag dat bepaalt dat staten door middel van nationale wetgeving maatregelen moeten treffen om op bepaalde plaatsen, zoals 'indoor public places', een effectieve bescherming tegen blootstelling aan tabaksrook te bewerkstelligen.
Heeft het WHO Kaderverdrag (specifiek: art. 8) rechtstreekse werking?
Het hof oordeelt, in tegenstelling tot de rechtbank, dat de uitzondering voor kleine cafés onverbindend is en onrechtmatig jegens CAN, omdat mensen zich daardoor in één ruimte bevinden met mensen die roken; hetgeen in strijd is met art. 8 lid 2 WHO-Kaderverdrag. Aan dit artikel komt rechtstreekse werking toe voor zover het gaat om 'indoor public places', een begrip waar kleine cafés onder vallen. Het hof betrekt in de overweging het gegeven dat het geen tijdelijke uitzondering betreft (bijvoorbeeld omdat het een overgangsmaatregel betreft). Het gaat in casu om het terugdraaien van een beschermingsmaatregel die al van kracht was.
De Hoge Raad oordeelt dat het hof terecht heeft verklaard dat de uitzondering voor kleine cafés onverbindend is en dat art. 8 lid 2 WHO Kaderverdrag verplicht tot een effectieve bescherming tegen blootstelling aan tabaksrook in onder meer openbare gebouwen zoals kleine cafés. Zowel uit de tekst en doelstelling van deze bepaling (voorkomen van dood en schade aan de gezondheid door blootstelling aan tabaksrook) volgt dat deze bescherming geldt voor eenieder die deze ruimtes betreedt of wil betreden.
De verplichting van art. 8 lid 2 WHO Kaderverdrag verzet zich tegen de alsnog gemaakte uitzondering voor kleine cafés. De Staat moet weliswaar een redelijke tijd krijgen om een verdragsverplichting na te komen; hierbij mogen ook overgangsmaatregelen genomen worden. Omdat er echter al een verplichting voor de beheerders van kleine cafés bestond om een rookverbod in te stellen, doet zich in casu de vraag niet voor of de Staat meer tijd had moeten hebben om tot wetgeving of andere maatregelen te komen, noch de vraag of de uitzondering voor kleine cafés als overgangsmaatregel gerechtvaardigd zou zijn.
Deze uitspraak heeft tot gevolg dat de uitzondering op het rookverbod onverbindend is.
