Feiten
In 2001 is in Nederland mond-en-klauwzeer uitgebroken. Op grond van de wet en artikel 5 van Richtlijn 85/511 EEG1 was de Minister verplicht om zieke en verdachte dieren te doden om verdere verspreiding van het virus tegen te gaan. Ingrijpende maatregelen werden genomen en er zijn toen meerdere procedures gevolgd, onder andere door veehouders.
I.c. betrof het bezwaar en beroep tegen het besluit tot verdachtverklaring en de ruiming van de veestapel. In deze zaak werd (anders dan andere vergelijkbare zaken) geen beroep gedaan op de mogelijkheid om aan artikelen 11 en 13 jo. Bijlage van Richtlijn 85/511 rechtstreeks rechten te
ontlenen. Het CBb wilde daarom van HvJ EG weten of hij niet ambtshalve moest toetsen aan de bepalingen van de Richtlijn. Volgens het College was het namelijk niet bevoegd om op grond van het Nederlandse BPR (art. 8:69 Awb) zelf over te gaan tot ambtshalve toetsing aan de richtlijn.
Het CBB stelt prejudiciële vragen om te vernemen of het gemeenschapsrecht de nationale rechter verplicht de rechtmatigheid van een bestuurshandeling ambtshalve te toetsen aan gronden ontleend aan Richtlijn nr. 85/511.31
HvJ EG
Het Hof stelt nogmaals dat de procedurele autonomie moet voldoen aan de beginselen van gelijkwaardigheid en doeltreffendheid. M.b.t. het gelijkwaardigheidsbeginsel bevestigt het Hof wat het CBb al eerder had gesteld. Voorschriften over de bevoegdheden van bestuursorganen en van rechters, alsmede bepalingen op het gebied van ontvankelijkheid, zijn van openbare orde in het Nederlandse recht. Alleen daaraan kan ambtshalve worden getoetst.
Het Hof oordeelt dan ook dat de artikelen van Richtlijn 85/511 niet als gelijkwaardig met de nationale regels van openbare orde kunnen worden aangemerkt. Daarom hoefde het CBb die dus niet ambtshalve toe te passen.
Wat betreft het doeltreffendheidsbeginsel stelt het Hof dat dit zich niet verzet tegen artikel 8:69 Awb. Dit artikel belet de Nederlandse rechter ambtshalve het gemeenschapsrecht toe te passen, als hij daarvoor de passende lijdelijkheid zou moeten verzaken of zou moeten treden buiten de door de partijen gepresenteerde aanvang van het geschil. Volgens het Hof maakt het hierbij niet uit dat het CBb als eerste en hoogste instantie oordeelt.
Kern: de (bestuurs)rechter moet niet ambtshalve het gemeenschapsrecht toepassen.
