Braak bij binnentreden (HR 12-12-1978, NJ 1979, 142)
Casus
In deze zaak gaat het om R., een opsporingsambtenaar van de Radiocontroledienst van de PTT. R. werkte op de afdeling Opsporing Clandestiene Zenders in Den Haag. In april 1976 werd hij belast met de opsporing van de illegale popzender Music Center.
De avond van 25 april lukte het R. om de zender van Music Center te peilen. Hierna heeft hij de politie ingeschakeld. R. kreeg assistentie van meerdere agenten. Enige uren later bleek dat de zender nog steeds aan het uitzenden was en bij het bewuste pand waar dat zou plaatsvinden brandde nog licht. R. heeft toen een buurvrouw gevraagd of hij via haar woning naar de tuin van het pand kon. Via een muurtje klommen R. en enkele agenten naar de tuin van Music Center. Door de glazen deuren zag R. radioapparatuur en drie personen in het pand. Waarna R. direct een ruit van de deur intrapte en naar binnen stapte.
Rechtsvraag
De vraag die dan o.a. in de procedure speelt, is of de opsporingsambtenaar die bevoegd is een woning te betreden in alle gevallen de woning door middel van braak (bijvoorbeeld door het inslaan van een ruit) mag betreden. Niet alles is namelijk toegestaan om zich de toegang tot een pand te verschaffen.
Hoge Raad
De opsporingsambtenaren hadden de bevoegdheid om binnen te treden, echter de manier waarop van deze bevoegdheid gebruik werd gemaakt, is onrechtmatig, ofwel buitenproportioneel. De Hoge Raad stelt dat de medewerker van de Radiocontrodienst te ijverig is geweest. Wanneer een opsporingsambtenaar een machtiging heeft, of zoals in casu, hij handelt volgens een bij een bijzondere wet gegeven bevoegdheid tot binnentreden, mag hij niet zonder meer overgaan tot braak.
De Hoge Raad geeft aan dat het “beginsel van een goede procesorde” meebrengt dat geen grotere inbreuk op de huisvrede mag worden gemaakt dan noodzakelijk is. Als in een specifiek geval kan worden volstaan door aan te bellen, dan mag niet met geweld toegang worden geforceerd. Voordat dwang wordt gebruikt, moet men de gelegenheid tot vrijwillige medewerking verlenen.
Kern
De Hoge Raad heeft geoordeeld dat toepassing van geweld niet onevenredig mag zijn ten opzichte van het doel waartoe wordt binnengetreden. Beginselen van behoorlijk bestuur zijn ook toepasbaar bij handelen van strafrechtelijke autoriteiten.
