Casus
De verdachte in deze zaak is de bestuurder van een personenauto, merk Volvo. Hij wordt ervan verdacht opzettelijk te hebben gehandeld in een verkeerssituatie, waardoor er een verkeersongeval heeft plaatsgevonden op de rijksweg N335 tussen Etten en Zeddam.
De verdachte reed op 8 februari 2008 in de gemeente Montferland op de rijksweg N335, toen een bedrijfsauto de verdachte wilde inhalen. Beide automobilisten reden over de rijksweg, in de richting van Etten. De bedrijfsauto wilde een inhaalmanoeuvre verrichten, waarbij hij op de linkerrijstrook ging rijden. Terwijl de bedrijfsauto wilde inhalen, verhoogde de verdachte, rijdende in zijn Volvo eveneens zijn snelheid, waardoor de bedrijfsauto geen ruimte kreeg bij het inhalen. Op een gegeven moment kwam er een personenauto op de rijksweg N335 vanuit de richting van Etten, waardoor de bedrijfsauto weer terug moest naar zijn eigen rijstrook en de inhaalmanoeuvre moest afbreken. Terwijl de bedrijfsauto invoegde op de rechterrijstrook, raakte hij de Volvo ter hoogte van het linker voorspatbord. Als gevolg van deze botsing, remde de Volvo met volledig geblokkeerde wielen, waardoor de verdachte met zijn Volvo op de rijstrook voor het tegemoetkomende verkeer terecht kwam. Ter hoogte van hectometerpaal 13.3 kwam de Volvo frontaal in botsing met de tegemoetkomende personenauto, merk Renault, vanuit de richting van Etten.
Het slachtoffer, bestuurder van de Renault, type Clio, kleur rood, was afkomstig van kennissen uit Etten. Hij reed samen met zijn vrouw over de rijksweg N335 toen hij in botsing kwam met de Volvo van de verdachte. Zijn vrouw is ten gevolge van het ongeval overleden en hijzelf heeft ernstige verwondingen opgelopen.
De verdachte wordt roekeloosheid ten laste gelegd, wegens het niet verlenen van ruimte aan de witte bedrijfsauto gedurende zijn inhaalmanoeuvre.
Hoge Raad
De Hoge Raad geeft aan dat voor de schuldvorm ‘roekeloosheid’ geldt dat het wordt gezien als de zwaarste vorm van het culpose delict, wat wordt aangemerkt tot een verdubbeling van het maximum van de op te leggen vrijheidsstraf. De rechter moet vaststellen of er sprake is van een buitengewoon onvoorzichtige gedraging van de verdachte, waarmee ernstig gevaar in het leven is geroepen, wil er sprake zijn van ‘roekeloosheid’ in de zin van art. 175 lid 2 Wegenverkeerswet. De Hoge Raad oordeelt dat het Hof een onjuiste overweging heeft gemaakt door het verhinderen van een inhaalmanoeuvre te kwalificeren onder het begrip ‘roekeloosheid’.
