'Redelijk vermoeden van schuld’ en ‘ernstige bezwaren’ Art. 56 en 359 Sv
Casus
Er werd een inval gedaan in ‘Ruimte’, een jongerencentrum. Bij de politie was bekend dat in het jongerencentrum ‘Ruimte’ op grote schaal drugs werd gebruikt en verhandeld, hetgeen op de bewuste avond nog eens werd geconstateerd door een aantal politiebeambten. De verdachte is door een politiebeambte aangewezen als iemand die drugs in zijn bezit had. De verdachte bevond zich op die avond in het jongerencentrum en is onderzocht aan zijn kleding, waardoor werd ontdekt dat hij 30 gram hennep bij zich droeg.
Rechtsvraag
Konden de door het Hof aangenomen feiten ernstige bezwaren opleveren in de zin van art. 56 Sv?
Rechtsgang
Het verweer stelt dat er geen voldoende grond bestond voor het aannemen van ‘ernstige bezwaren’ in de zin van art. 56 Sv, wat nodig is om een verdachte te kunnen onderzoeken aan zijn kleding. Daarom is het bewijs onrechtmatig verkregen en mag dit niet meegenomen worden in de beoordeling.
Het Hof heeft in hoger beroep het vonnis van de Rechtbank bevestigd en de gronden aangevuld. Het Hof stelt vast dat het bij de leiding van de politie bekend was dat er in het jongerencentrum Ruimte verdovende middelen werden gebruikt en verhandeld. Daarbij heeft 1 van de politiebeambten de verdachte aangewezen aan de hoofdagent, dat de verdachte drugs in zijn bezit had. Volgens de HR is er voldoende grond voor het aannemen van ‘ernstige bezwaren’. Het Hof baseerde zijn oordeel op 2 gronden. Het middel bestrijdt er slechts 1 van de gronden. De beslissing van het Hof wordt door de andere grond zelfstandig gedragen. Het beroep wordt verworpen.
Het was voor de HR moeilijk om een oordeel te vellen over deze zaak, omdat het hier gaat om het vaststellen van de bewijzende betekenis van een gegeven. De HR is geen feitenrechter en kon de zaak slechts beoordelen aan de hand van de door het Hof vastgestelde feiten.
Conclusie
Onder de gegeven omstandigheden bestaan er voldoende ernstige bezwaren tegen de aangehouden verdachte. Het Hof heeft dit gebaseerd op 2 gronden. Het middel bestrijdt slechts 1 van de 2 gronden en laat de andere onverlet die de beslissing van het Hof zelfstandig kan dragen.
