Verbetering misslag in tenlastelegging (HR 30-09-2008, NJ 2009/494)
Casus
Wegens een aantal overtredingen van de Wegenverkeerswet 1994 en onverzekerd besturen van een auto werd de verdachte in hoger beroep veroordeeld tot hechtenisstraffen, geldboete en ontzeggingen van de rijbevoegdheid. Aan de verdachte is o.a. tenlastegelegd dat hij op of omstreeks 19 juni 2005 te 's-Gravenhage als bestuurder van een auto, dronken en zonder rijbewijs heeft gereden.
Het Hof heeft het ten laste van de verdachte bewezenverklaard. In aansluiting op de bewezenverklaring heeft het Hof het volgende overwogen: "Voorzover in de tenlastelegging taal- en/of schrijffouten voorkomen, zijn deze in de bewezenverklaring verbeterd. Blijkens het verhandelde ter terechtzitting is de verdachte daardoor niet geschaad in de verdediging."
Het ligt op de weg van de rechter om in de tekst van een tenlastelegging voorkomende misslagen te verbeteren, als de verdachte daardoor in zijn verdediging niet wordt geschaad. Zo'n verbetering is niet een wijziging van de tenlastelegging in de zin van art. 313 Sv, maar alleen een vaststelling van de juiste inhoud van de tenlastelegging waarvoor geen medewerking van het OM of van de verdachte is vereist.
Het Hof heeft de in de tenlastelegging vermelde tijdsaanduiding 'op of omstreeks 19 juni 2005' in de bewezenverklaring gewijzigd in 'op 16 september 2005'.
Het middel bevat de klacht dat het hof ten onrechte in de bewezenverklaring de data, vermeld in de tenlasteleggingen, heeft gewijzigd.
Hoge Raad
Het Hof heeft de in de tenlastelegging vermelde tijdsaanduiding 'op of omstreeks 19-06-2005' in de bewezenverklaring gewijzigd in 'op 16-09-2005'. Het Hof had i.c. gelet op de aard van de wijziging, zijn oordeel dat sprake is van een misslag nader behoren te motiveren. Dat geldt ook voor zijn oordeel dat verdachte die noch in eerste aanleg noch in hoger beroep is verschenen door de aangebrachte wijziging niet in zijn verdediging is geschaad.
De Hoge Raad wijst de zaak terug naar het Gerechtshof te 's-Gravenhage, opdat de zaak in zoverre op het bestaande hoger beroep opnieuw wordt berecht en afgedaan.
Kern
De rechter mag misslagen in de tekst van een tenlastelegging verbeteren, mits de verdachte daardoor in zijn verdediging niet wordt geschaad. Zo een verbetering is niet een wijziging van de tenlastelegging in de zin van art. 313 Sv. Het betreft een vaststelling van de juiste inhoud van de tenlastelegging waarvoor geen medewerking van het OM of van de verdachte is vereist. Dit moet dan wel voldoende worden gemotiveerd.
